'Order published but not passed’ by Supreme Court in Sexual Harassment Case Against CJI AMARESH PATEL WOMEN RELATED LAWS Sun, Apr 21, 2019, at ,12:34 PM The Hon’ble Bench of Supreme Court passed an order on alleged sexual harassment of a former court staff of the Supreme Court by CJI Ranjan Gogoi which is available on its website. But the order passed by Supreme Court reads as under “Having considered the matter, we refrain from passing any judicial order” But the order is available on the website on Supreme Court. Murali Krishnan, reporting the case, questions whether the order so available on website on Supreme Court is not binding in nature. And, if it is not binding, why it has been published on website. The bench refrained from passing an order because since CJI is on the bench and he is also accused in this case. It would be a conflict of interest since the case relates to CJI personally. However, the name of CJI has not been mentioned in the order so passed by Supreme Court but he has been dominating the same. He speaks against the allegation in capacity of Chief Justice of India and being part of the bench (officially or unofficially), he mentioned, he was being targeted in this manner stating that he has an unblemished career or more than twenty years during which he has been able to amass only Rs 6.8 Lakhs in saving. Since, allegations regarding financial propriety could not be raised, such tactics of sexual harassment allegations were being resorted to. The question is, if CJI was not the part of the order, then why he has his opinion, in capacity of Chief Justice of India and headed the bench. As, the court passed an order which is not available on the website of the Supreme Court, has the name of Justice Arun Mishra and Justice Sanjiv Khanna and not CJI Ranjan Gogoi. Though he has been part of the bench and has made is opinion on the matter.
