Is it legal for the government to pass regulations governing women's access to abortion? Aagya Jain Legal Article Mon, May 08, 2023, at ,04:41 PM We all live in a world where we are free to live our lives and make our own decisions without fear of persecution or prejudice, yet people are detained all over the world for prioritising their own lives over those of others and are subjected to bullying and discrimination as a result. Nearly 40% of women of reproductive age reside in nations that forbid or severely restrict abortion, and where women are also prohibited from using contraception even if they wish to cease not having children. In our culture, we should all speak out against the taboos that are primarily enforced by the government, our neighbourhoods, and even our family. There should be no third-party control over the decision like when having children or when to abort or not, these are our rights to decide whether we want it or not and why it is becoming a matter for the government to control it.The American Supreme Court has drafted a devasted opinion on Thomas E Dobbs V. Jackson Women Health Organization in which the court prohibited the abortion of a foetus above the age of 15 weeks except in the case of emergency. With this many, American women have lost their fundamental protection and yes, it is important to discuss the government's rights and control over women’s bodies. Can other countries also adopt this judgment later? If someone controls one's body, it is the same as controlling one's life; the World Health Organisation states that abortion is a fair practice; there are approximately 73 million abortions performed worldwide annually, out of which 45% are unsafe; it is beneficial for the government to pass laws that affect fundamental equality in a positive way. However, the question is whether these laws are applicable or whether women are receiving their fundamental rights in an affirmed way, now where are the rights of women, women are not the source of the economy and all have to understand it.In the case of gender, women have few legal protections but what about the lives and control of their own bodies, Yes, we may say that the condition is far better than years, but the current state of the law is not enough for this system. As the U.S. Supreme Court has overruled the case of Roe v. Wade 410 US 113 (1973) which was the landmark judgment that established that abortion is a constitutional right. The court backed up the Mississippi Gestational Age Act which the law bans abortion after 15 weeks in the controversial case of Dobbs v. Jackson Women’s Health Organization 597 U.S. (2022).A person has the right to their body if they do not want to become pregnant, and the Dobbs decision directly jeopardises those rights as well as the autonomy of one's body. Abortion has a significant impact on many different things and offers rape victims some hope. “An individual person should have their rights to make decisions about their bodies these are the absolute rights and cannot be entertained by judges.” “By overruling Roe and Casey, the court not only held that there is no constitutional right to abortion but they also determined the abortion will not be subject to the viability.”ImpactsThe impact of these bans will be mostly hard on the people who are already facing discrimination and can’t afford good healthcare facilities and other drugs for living, the decisions of abortion should be in the hands of an individual not on the government and their laws. As the court has taken about the 13th, and 14th century there is no logic for that as at that time there was discrimination and no laws were maintained and the act which is mentioned by the court about the Mississippi Gestational Age Act, Mississippi had the worst infant mortality rate in the country and the court almost ignores all these facts. The majority does not understand the harm of taking the rights away which is fundamental for liberty and equality.ConclusionThe Dobbs v. Jackson Women's Health Organisation case is a frontal assault on abortion access on its own. It has sparked a serious legal, public health, and most crucially, constitutional validity dilemma that could ultimately have an impact on the entire world.Without committing all of the reproductive rights violations, including nationalistic, economic, and racist ones as well, achieving gender equality and freedom is impossible. Every woman should be in command of her body and have the choice to decide how many children she wants to have.No matter what this lawless court says, a woman's right to choose whether or when to have children is a fundamental one that governs gender equity and her own physical autonomy.References https://www.supremecourt.gov/opinions/21pdf/19-1392_6j37.pdf https://reproductiverights.org/case/scotus-mississippi-abortion-ban/ https://www.ncbi.nlm.nih.gov/pmc/articles/PMC9673802/
