Justice D Y Chandrachud: Credibility of Supreme Court would be damaged if probe continues in absence of complainant Amaresh Patel TOP STORIES Sun, May 05, 2019, at ,11:07 AM In a sensitive case of national importance where acting CJI has been accused of sexual harassment by a woman employee, the in-house committee probing allegation of sexual harassment against CJI Ranjan Gogoi, comprising of Justice S A Bobde, Indu Malhotra and Indira Banerjee, has decided on 30th April, to proceed “ex-parte” which means the probe will continue even in absence of the woman complainant. The decision was taken when the woman complainant walked out of the panel stating that the judges who were in the panel refused to allow a lawyer or support person to accompany her during her deposition. In response to which, Justice Nariman, who is fifth in the seniority among the judges, and Justice D Y Chandrachud, who is 10th in the seniority among the judges, met the inquiry panel and further wrote that the credibility of the Supreme Court would be further damaged if they (designated panel) decided to continue with the probe in the absence of the complainant, who has withdrawn from the inquiry. He also suggested that the committee could either accede to the complainant’s ‘equest to provide her with a lawyer or appoint an amicus curiae for the probe’. Whatsoever the truth is, fair and due procedure of law, shall be followed, to deliver justice. As this case has the attention of entire nation.
