Module 1: Foundations of Labour & Employment Law - Old Regime vs New Labour Codes

  • Evolution and need for labour law reforms

  • Overview of the Four Labour Codes

  • Key definitional changes and applicability thresholds

  • Central vs. State implementation status

  • Practical issues in transition and compliance

 

Module 2: Employment Lifecycle & Drafting of Employment Documentation

  • Essentials of a sound employment agreement

  • Drafting and review of:

    • Appointment letters

    • Employment contracts

    • Fixed-term and contractual employment agreements

  • Classification of workforce (permanent, contractual, gig & platform workers)

Practical Exercise: Draft a complete employment contract.

 

Module 3: POSH Act & Workplace Policies

  • Overview of the Sexual Harassment of Women at Workplace (POSH) Act, 2013.

  • Employer obligations (policy, awareness, training) and Internal Committee (IC) requirements.

  • Procedure for complaints, inquiry and penalties.

  • Policy Drafting: Creating or updating an internal POSH policy and Code of Conduct. Instituting complaint mechanisms and confidentiality rules.

Practical Exercise: Conduct a mock POSH committee session on a hypothetical complaint, and draft a compliant Internal Committee report.

 

Module 4: Social Security, EPF, ESI & Occupational Safety

  • Code on Social Security, 2020

    • EPF, ESI, gratuity, maternity and other social security schemes

    • Coverage of unorganised, gig and platform workers

    • Transition from earlier social security legislations

  • EPF & ESIC - Practical Procedures

    • Employer and employee registration

    • Contribution calculations and payment timelines

    • Monthly/periodic filings, challans and returns

    • Handling EPF and ESIC claims (medical, sickness, maternity, pension)

  • Occupational Safety, Health & Working Conditions Code, 2020

    • Applicability

    • Employer duties: safety officers, health checks, welfare measures

    • Accident reporting, inspections, and compliance regime

    • Core safety compliances carried forward from the Factories Act
       

Module 5: Code on Wages & Working Conditions (Compliance in Practice)

  • Code on Wages, 2019

    • Minimum wages, floor wages, equal remuneration

    • Payment timelines and mode of payment

    • Bonus provisions subsumed from the Payment of Bonus Act

    • Employer obligations: wage payment, deductions, registers & records

  • Working Conditions under the Codes

    • Hours of work, overtime, weekly holidays, shifts

    • Leave and rest intervals

    • Mandatory notices and displays (minimum wages, abstracts, etc.)

 

Module 6: Industrial Relations, Trade Unions & Collective Bargaining

  • Industrial Relations Code, 2020

    • Lay-off, retrenchment and closure procedures

    • Penalties and compliance obligations

  • Trade Unions & Collective Bargaining

 

Module 7: Labour Law Due Diligence (Corporate & M&A Focus)

  • Scope and objectives of labour law due diligence

  • Identifying non-compliances and contingent liabilities

  • Review of employment contracts, policies, and statutory records

  • Drafting labour due diligence reports and risk mitigation strategies

 

Module 8: Labour Disputes, Litigation & Dispute Resolution Mechanisms

  • Authorities under the Labour Codes

  • Conciliation, adjudication, and appellate forums

  • Jurisdiction of Labour Courts and Industrial Tribunals

  • Remedies and reliefs available to workmen and employers

  • Process for raising industrial disputes

  • Settlement, conciliation agreements, and enforcement.
