Kerela High court Quash Fir against Enforcement Directorate Admin Fri, Apr 16, 2021, at ,02:16 PM The Kerala High Court quashed two FIRs registered by the crime branch of the state police against 'unnamed officers' of Enforcement Directorate based on the revelation by Swapna Suresh and Sandeep Nair, accused persons in the gold smuggling case, stating that the ED officers had forced them to state Chief Minister of Kerala. the petitions filed by P Radhakrishnan, deputy director, Enforcement Directorate, Kochi seeking to quash the FIRs, Justice V G Arun observed that the bar under Section 195 (1) (b) of the CrPC applies to the offenses mentioned in the two FIRs.The Crime Branch registered the case on March 17 based on a report filed by its team which was probing the leak of a voice clip, purportedly belonging to Suresh. The Crime Branch case was registered under Section 120-B (criminal conspiracy), 167 (public servant framing an incorrect document with intent to cause injury), 192 (fabricating false evidence), 195-A (threatening any person to give false evidence), among others, of the Indian Penal Code.
