An affidavit looks like the simplest document in a lawyer's file: a few paragraphs, a stamp paper, a notary's seal. Yet affidavits are rejected every day because a name is spelt two ways, the verification clause is missing, or the document was signed without the deponent appearing before the notary. Since an affidavit is a statement on oath, a mistake in it can also expose the deponent to prosecution.

What Is An Affidavit And Where Does Its Legal Force Come From?

An affidavit is a written statement of facts, made voluntarily and confirmed by the person making it (the deponent) on oath or solemn affirmation before an authority empowered to administer oaths, such as a notary public, an Oath Commissioner or a Magistrate. The Oaths Act, 1969 governs oaths and affirmations, and the Notaries Act, 1952 governs notaries.

In litigation, affidavits carry more weight. Order XIX of the Code of Civil Procedure deals with affidavits in court proceedings and, as a general rule, limits them to facts the deponent can prove from personal knowledge. Order XVIII Rule 4 provides for evidence in chief to be given by affidavit in civil trials.

A false statement in an affidavit is not a technicality. It can lead to prosecution for giving false evidence under the Bharatiya Nyaya Sanhita, 2023, which replaced the Indian Penal Code. Draft only facts the deponent knows to be true.

Standard Format Of An Affidavit

Whatever the purpose, a well drafted affidavit follows the same skeleton:

  • Title: "Affidavit", with the name of the court or authority and the case number if it is filed in a proceeding

  • Deponent details: full name, father's or husband's name, age, occupation and complete address

  • Opening statement: "I, [name], do hereby solemnly affirm and state on oath as under"

  • Numbered paragraphs: each stating one fact, in clear and simple language, in a logical order

  • Purpose clause: the reason the affidavit is being made and the authority it will be produced before

  • Verification: a closing paragraph stating that the contents are true and correct to the deponent's knowledge, that nothing material has been concealed, and (where applicable) which paragraphs are true to personal knowledge and which are based on information believed to be true

  • Place and date: where and when the affidavit was signed

  • Signature of the deponent on every page

  • Attestation: the notary's or Oath Commissioner's signature, seal, registration number, date and confirmation that the deponent was identified and signed in their presence

Stamp paper. Affidavits are usually executed on non-judicial stamp paper, or with e-stamping, of the value prescribed by the state. The amount varies from state to state, so confirm it locally before executing.

Name Change Affidavit: How To Draft It

India has no separate statute that grants a name change. A person can adopt a new name and prove the change through documents. In practice, an affidavit is the first step, and most authorities also ask for public notice.

The usual process:

  • Execute a name change affidavit on stamp paper, stating the old name, the new name and the reason for the change

  • Get it notarised

  • Publish a notice of the change in newspapers, often one in English and one in a local language

  • Publish the change in the Gazette of India (or the state Gazette), which is the record most departments accept as formal proof

  • Use the affidavit, newspaper clippings and Gazette notification to update the Aadhaar, PAN, passport, bank accounts, educational records and other IDs, following each authority's own checklist

Key paragraphs to include:

  • The deponent's present name, parentage, age and address, and how the old name appears in official records

  • A clear statement that the deponent has changed the name from the old name to the new name, and the reason (for example marriage, divorce, spelling correction, personal preference or religious reasons)

  • A declaration that both names refer to the same person, with details of the existing documents that carry the old name

  • A declaration that the change is not made for any fraudulent or illegal purpose, and not to avoid any liability

  • For a minor, an affidavit by the parents or guardian, with consent from both parents where possible

  • Verification and attestation as in the standard format

Points to watch: use the name exactly as it appears in the existing records, keep spelling, initials and order identical across every document, and check the latest checklist of the authority (for example the passport office or the Aadhaar centre) before you draft, because acceptance requirements change.

Address Proof Affidavit: How To Draft It

An address proof affidavit is a self-declaration of residence, used when a person does not have a standard document such as a utility bill, rent agreement or registered sale deed in their name. It is commonly asked for in bank, gas connection, school admission and government office formalities.

Key paragraphs to include:

  • The deponent's full name, parentage, age and occupation

  • The complete present address, with pin code, and the period the deponent has been residing there

  • The nature of occupation: owned, rented, or living with a parent, relative or friend

  • Where the deponent lives in someone else's property, a no objection statement from the owner or host, along with a copy of their ownership proof and identity

  • The purpose for which the affidavit is made and the authority before which it will be produced

  • A declaration that the details are true and the affidavit is made voluntarily

  • Verification and attestation as in the standard format

Points to watch: an affidavit is a supporting document and is not accepted as address proof by every authority. Some require it together with other identity documents, or reject it for certain purposes. Confirm with the institution first, and make sure the address in the affidavit matches the address on the other documents.

Common Mistakes In Affidavit Drafting

  • Spelling or initial mismatches between the affidavit and the deponent's ID documents

  • Missing verification clause, or a vague verification that does not separate personal knowledge from information

  • Using the wrong or insufficient stamp paper for the state

  • Signing without appearing before the notary, or notary details left incomplete

  • Loose, unsigned pages, overwriting or cutting without initialling

  • Mixing facts, arguments and legal opinion in a court affidavit, instead of stating only facts

  • Untrue or unverified statements, which can expose the deponent to prosecution
