Course Overview

Mediation today is not just an alternative to litigation: it is fast becoming a preferred way of resolving disputes. With our courts burdened by millions of pending cases, there is a growing need for mechanisms that are quicker, cost-effective, and capable of preserving relationships. Mediation does exactly that. Recognizing this, the Bar Council of India (BCI), through its circular dated 13 August 2020 (BCI:D:1897:2020), made Mediation with Conciliation a compulsory subject in the LL.B. curriculum. The BCI’s vision is clear: law students and young professionals must be trained not only in the theory of mediation but also in the practical skills required to conduct it effectively

Into Legal World Institute in collaboration with School of Law and Legal Affairs, Noida International University, presents this 40-Hours Mediation Training and Certification Program in line with the BCI’s vision and syllabus. It provides participants with a well-rounded understanding of mediation. Starting from the basics of conflict and ADR, to communication techniques, problem-solving strategies, drafting clear and enforceable settlement agreements, understanding Mediation Act 2023 and exploring international developments such as ODR and the Singapore Convention on Mediation.

The aim is to ensure that participants not only understand mediation as a process but also gain the ability to conduct mediation sessions effectively and draft enforceable agreements.

Module 1: Introduction to Conflict & ADR

Conflict: causes, types, escalation & de-escalation.
Disputes as manifestations of conflict.
ADR mechanisms: Negotiation, Mediation, Arbitration, Adjudication.
Limitations of litigation and advantages of mediation.
Mediation in India: case pendency crisis, access to justice, etc.
Mediation & Restorative Justice.

Module 2: Mediation Fundamentals

Mediation essentials: voluntary, confidential, non-coercive.
Stages: opening session, joint sessions, caucus, settlement.
Approaches: Facilitative, Evaluative, Transformative.
Role of mediator: facilitator, neutral moderator, not a legal advisor.
Exercise: Faculty conducts a sample mediation.

Module 3: Communication Skills for Mediators

Verbal & non-verbal communication: clarity, tone, body language.
Active listening, empathy vs sympathy.
Questioning techniques: open-ended, rephrasing, summarizing.
Rapport building & trust creation.
Exercise: Paired Listening Exercise. One speaks, one listens silently and summarizes.

Module 4: Problem-Solving & Decision-Making in Mediation

Identifying interest’s vs positions.
BATNA, WATNA, MLATNA: strategic use in mediation.
Overcoming impasse: time-outs, reframing, deadlines, brainstorming.
Negotiation: distributive vs integrative; “win-win” solutions.
Exercise: Simulation: Commercial lease dispute → Apply BATNA/WATNA/MLATNA.

Module 5: Mediator’s Ethics & Confidentiality

Ideal mediator qualities: neutrality, patience, creativity, diplomacy.
Ethical dilemmas: impartiality, conflicts of interest, power imbalance.
Confidentiality scope: caucus sessions, offers, settlement terms.
Abuse prevention and fair process.
Exercise: Students role-play as mediators to decide - How to balance neutrality, confidentiality, and fairness?

Module 6: Mediation Act, 2023

Objectives & scope of the Act.
Mandatory pre-litigation mediation.
Online mediation.
Mediation Council of India: Role & Accreditation.
Settlement agreements: Enforceability as court decrees, exceptions.
Disputes excluded from mediation.
Impact on Indian dispute resolution system.
Exercise: Faculty to present 4–5 short case scenarios. Student task is to decide which disputes are fit for mediation under the Mediation Act, 2023 and which are excluded.

Module 7: Drafting Settlement Agreements

Essentials of drafting: clear terms, measurable commitments, monitoring provisions.
Vitiating factors: fraud, coercion, public policy.
Exercise: Drafting Workshop. Students draft a short settlement agreement (e.g., between employer–employee on wrongful termination)

Module 8: International & Online Mediation

Online Dispute Resolution (ODR)
UNCITRAL Model Law on International Commercial Mediation and International Settlement Agreements Resulting from Mediation, 2018
Singapore Convention on Mediation.
International best practices, accreditation, global standards.
Exercise: Virtual Mediation Role Play. Students conduct a mock ODR session via Zoom/Teams on a cross-border business dispute.

Miss. Kathleen Ruane Leedy

Kathleen Ruane Leedy is a highly trained, experienced bi-coastal Mediator, Trainer, Consultant, Author, and Advocate, specializing in high-conflict mediations with nearly 1,000 cases and over a 95% agreement rate since 2008. She served as Courts and Training Coordinator at Family Services of Central Massachusetts, overseeing five courts, training mediators, and developing programs. She has mediated in Central MA, Greater Boston, Tacoma, Seattle, Atlanta, Des Moines, El Paso, and Honolulu, while also mentoring mediators and teaching the 40 Hr. Basic Mediation Training class. Kathleen has volunteered at Harvard and coached MIT graduate students in negotiation and conflict management, and has spoken to aspiring lawyers nationwide. She has also judged INADR law school mediation tournaments and trained mediators worldwide.
